TERMS OF SERVICE
The following terms of service are agreed upon between, on the one hand, Bluedot-Tech SASU based in Nieppe with a registered capital of 500 euros, registered in the Dunkerque Trade and Companies under number 84185560400028 further designated as "the seller" and on the other hand, any person or company, further designated as "the buyer" willing to purchase any product on the seller's website.
Subject
Following terms of service are aimed at defining contractual relations between the seller and the buyer and applicable conditions to any purchase executed using the seller's website, whether the buyer is professional or consumer.
Acquisition of a good or service through the buyer's site implies a full acceptance of terms of service.
These terms of service will prevail over any other specific conditions that have not been approved by the seller.
The seller reserves the right to modify terms of service at any time.
In such case, applicable conditions will be those of terms of service at the moment of buyer's order.
Nature of proposed goods and services
Proposed goods and services are shown in the seller's website catalogue.
These goods and services are available in the limit of available stock.
Catalogue pictures are as accurate as possible but might not picture perfectly related products, especially about colours.
Prices
Prices displayed in catalogue contain VAT and are in euros. Prices take account of applicable VAT at the time of buyer's order ; any VAT rate change might alter goods and services prices.
The seller reserves the right to modify prices at any time, being agreed that the prices of products bought by the buyer at the time of order will be the only applicable prices for the buyer for said order.
Shown prices might contain processing, shipping and delivery fees if related orders are placed for intended geographic areas listed below.
Geographic areas
Online buying of goods and services on the seller's website is only possible for buyers living in
- France (overseas included)
- Monaco and Andorra
- Members of European Union
and for deliveries required in these geographic areas.
Orders
The buyer who wants to purchase a good or service must :
• supply his/her billing and shipping details;
• fill the order sheet online containing references of goods and services the buyer is willing to purchase;
• validate the order after checking it;
• carry out the payment under the conditions envisaged;
• confirm order and payment.
Order confirmation implies full acceptance of terms of service, that the buyer has read it and waive his/her own buying conditions or any other conditions.
Data supplied and recorded order confirmation are a proof of transaction.
Order confirmation equals a signature and acceptance of carried out operations.
The seller will send the confirmation related to buyer's order by email.
Retractation
The buyer has a right to retract from the order delivery to seven days after to return a product or more to the buyer in exchange to a refund without fees, except the buyer's forwarding fees.
Rectractation will be valid only if the buyer hasn't opened the product's wrapping he/she wishes to return.
Payment methods
The price must be provided by the seller at buyer's order.
Payments will be carried out by the buyer using credit card in Paypal or Payzen (secured payment system using SSL (Secure Socket Layer)) so that transmitted buyer data are encrypted to prevent third party from reading them during their transport on network.
A bill showing VAT for each ordered product must be provided by the seller at the request of buyer.
Delivery
Delivery is executed at shipment address indicated on order and can only be in an available geographic area.
The risks are the responsibility of the buyer from the moment when order products left the seller facilities. In case of damage during shipment, claim must be addressed to the carrier in a delay of three days after delivery.
Delivery dates are given as indications; if they exceed fifteen days starting from order, selling contract can be revoked and the buyer refunded.
Warranty
Every product supplied by the seller have a warranty according to articles 1641 and following of civil code.
In case a sold product is non-compliant, it can be returned to the seller who will exchange it or will refund it.
Every claim, exchange or refund demands must be done by email at the following address :

in a delay of thirty days following delivery.
Liability
The seller, in the online selling process, must only provide means ; he has no liability for damage resulting in Internet network issues and other issues such as data loss, intrusion, virus, service interruption or other involuntary problems.
Intellectual property
Every element in the seller's website are the exclusive intellectual property of Bluedot-Tech SASU.
No one is authorized to reproduce, use or distribute, even partially, any content, could it be a software, visuals or audio to any third party.
Any simple or hypertext link is strictly forbidden without express written agreement from the seller.
Personal data
Protection and management of personal date abides current EU laws. For further details, please consult the page labeled "Personal data" in the seller's website.
Archiving - Proof
The seller will archive orders and bills accurately on a reliable and durable medium, according to article 1348 of civil code.
Computerized records of the seller are to be considered by the seller and the buyer as proof for communications, orders, payments and transactions which have occurred between them.
Legal disputes
These terms of service are under French law.
In the event of litigation, responsibility is allocated to the courts of competent jurisdiction of Dunkerque, notwithstanding plurality of defendants or call in guarantee.
